This seminar is relevant to those involved in wrestling with issues around deprivation of liberty and mental health law in health and social care – including continuing healthcare, mental health, care and acute sectors.
The process of changing from the Deprivation of Liberty Safeguards to the Liberty Protection Safeguards is well underway and there are significant changes in terms of responsibilities and administration. The struggle with what deprivation of liberty actually is, following Cheshire West continues and we will look at the impact in terms of the Liberty Protection Safeguards and the discharge of mental health patients (MM and PJ), particularly in relation to the Transforming Care Agenda. That will lead in to the proposed changes to the Mental Health Act and its interaction with the Mental Capacity Act.
In this seminar we aim to clarify the existing law and explore the likely changes to help practitioners identify solutions and the work that needs to be done to prepare for yet more change.
For those whose main interest is the Liberty Protection Safeguards we are aiming to provide a discussion group after coffee as an alternative to presentations on mental health law.
