Under the Freedom of Information Act 2000, I am writing to request data regarding clinical negligence claims settled or lodged against the NHS between January 1, 2020, and December 31, 2025.
Specifically, I am requesting data for the following medical specialities:
· Ophthalmology
· Otolaryngology (ENT)
· Oral & Maxillofacial Surgery (MaxFax)
· Neurosurgery
· Plastic Surgery (specifically cases categorised as Head and Neck related)
Data Requirements:
Please provide the data broken down by the subheadings provided in the attached document.
For your convenience, these primary data fields include:
Administrative: Claims status (open, closed, or settled but not paid), incident date, NHSR notification date, date claim closed, primary speciality associated with claim, location of incident, CNST Member/ Trust name, defendant law firm, claimant law firm.
Clinical: Incident details/ description, primary cause, injury sustained, patient sex and age at incident
Financial: Damages paid, defence costs paid, claimant costs paid, total paid to date, total damages reserved/ claimed, total claimant costs claimed, claim scheme, outcome/ resolution method (e.g., settled out of court, trial, dropped).
