Service: Claims Management Cause: Fail / Delay Treatment, Wrong Diagnosis

The following information was requested:

 

Please tell me the number of claims closed or settled for each member of the NHS Resolution scheme (typically NHS Hospital Trusts but please include any other bodies such as the Department of Health) for the financial years, 2014/15, 2015/16, 2016/17, 2017/18, 2018/19 and – if available – 2018-19 to date, where one of the causes of the claim was either “failure/delay diagnosis” or “wrong diagnosis”.

Please break it down by the number of claims that were:

a) Open claims yet to be closed/settled

b) Closed with no damages paid (not found in favour of the claimant)

c) Settled with damages paid (found in favour of the claimant)

For the claims which were found in favour of the claimant please include the number of claims, the damages paid, defence costs paid, claimant costs paid.
