Please note that in order to find a relevant decision for a particular application type users should enter specific wording rather than the regulation number.  For example “Current Need” for regulation 13 or “Unforeseen Benefit” for regulation 18.

26143: Appeal against a breach notice

Function: Pharmaceutical performance related sanctions ICS/ICBS Region: East of England

Decision making body: NHS England/ICB Pharmaceutical contractor (sanction): Rosemead Ltd

Three Breach Notices dated 21 December 2023 were sent to Rosemead Ltd t/a Total Health Pharmacy (FAD81) in respect of 14 Gregor Shanks Way, Watton, Thetford, Norfolk, IP25 6FA.

26150: Application to relocate a pharmacy to Keighley

Function: Pharmaceutical (under 2012 & 2013 regulations) ICS/ICBS Region: North East and Yorkshire

Decision making body: NHS England/ICB Pharmaceutical contractor (entry): Healthcare Time Ltd

By application dated 24 June 2023, Healthcare Time Ltd (“the Applicant”) applied to West Yorkshire ICB (“the Commissioner”) for a relocation that does not result in a significant change to pharmaceutical services provision under Regulation 24 from 27 Newmarket Street, Skipton, BD23 2JE to Unit 6, Crown Works, Bradford Road, Sandbeds, Keighley, BD20 5LN.

26157: Application to open a pharmacy in Guildford

By application dated 20 June 2023, Kico Ltd (“the Applicant”) applied to Surrey Heartlands ICB (“the Commissioner”) for inclusion in the pharmaceutical list offering unforeseen benefits under Regulation 18 within 150m of 220 London Rd, Burpham, Guildford, GU4 7JS (best estimate).

26145: Application to change pharmacy opening hours

The Applicant has applied to the Commissioner to change the days and times at which it is obliged to provide pharmaceutical services at the above premises. The Applicant seeks to keep the total number of core opening hours the same while offering a different distribution of these hours during the week.

26170: Application to withdraw from the Dental Performers List

Function: Performers list management ICS/ICBS Region: North West

Decision making body: NHS England/ICB

In a letter to NHS Resolution dated 29 February 2024, NHS England – North West requested consent for Dr # (“the Performer”) to voluntarily withdraw from the Dental Performers List (the “List”). The letter stated the background to the case and gave reasons as to why consent to withdraw should be considered, along with an email from the Performer agreeing to be removed from the Performers List.

26131: Dispute regarding payment of childhood immunisations

The Contractor referred the dispute in relation to its General Medical Services Contract for dispute resolution under the provisions of Regulation 82 of the National Health Service (General Medical Services Contracts) Regulations 2015 (the “Regulations”).
