On 6 April 2020, a new state indemnity scheme for general practice in England, the Existing Liabilities Scheme for General Practice (ELSGP), was established to cover the historical liabilities of general practice staff. The new scheme complements the Clinical Negligence Scheme for General Practice, which was established on 1 April 2019 and covers liabilities of general practice incurred from 1 April 2019.
The ELSGP provides indemnity cover for NHS clinical negligence claims made against current and former GP members of medical defence organisations (MDOs) in respect of liabilities incurred before 1 April 2019. This is where terms have been agreed with MDOs in relation to indemnity provision for their GP members under the ELSGP. NHS Resolution administers the scheme on behalf of the Secretary of State for Health and Social Care, and in the first instance, is also responsible for claims handling.
The ELSGP currently covers historical liabilities for those who were members of the Medical and Dental Defence Union of Scotland (MDDUS) or the Medical Protection Society (MPS) at the time of the incident in respect of which a claim is made, and any practice staff working for the MDDUS or MPS member at the time of that incident.
If you have an ongoing claim which relates to an incident that occurred during your period of membership with the MDDUS or the MPS and while you were working in general practice providing NHS services in England prior to 1 April 2019, NHS Resolution, on behalf of the Secretary of State, in the first instance assumes responsibility for the handling of that claim.
