The following information was requested:
Under the provisions of the FOI Act, I am trying to find out more about compensation claims handled by all NHS Trusts, including the costs and details of each case. If my questions could be revised to better achieve a full disclosure, I’d be grateful for any advice you could give in that respect.
If it would exceed the cost and time limits of the Act to provide this data on a national basis (whilst this would be preferable) please limit the disclosure to the following Trusts:
- County Durham & Darlington
- North Tees & Hartlepool
- South Tees
- Gateshead
- South Tyneside & Sunderland
- Newcastle
- Northumbria
- Harrogate District
- York & Scarborough
- Cumbria Partnership NHS Foundation Trust
- Tees, Esk & Wear Valley
- Cumbria, Northumberland & Tyne & Wear
Please provide answers to the following questions in an Excel workbook:
1. How many compensation claims have been made against the Trust over the past five years? Please breakdown by year.
2. How many compensation claims has the Trust settled in the past five years? Please break down by year and the total cost of settlements paid out by the trust in each year.
3. For each of the claims settled, please provide:
- the total amount paid in settlement
- details of the complaint received where possible
- The date of the incident that led to the complaint
- The date the complaint was lodged
- The date the complaint was settled
4. Over the same period, how many claimants died while their case was on-going? In each of these cases, please provide details of their complaint and its outcome.
5. How much has the trust spent in legal fees associated with compensation over that period? Please break down by year and by legal costs awarded to claimants vs. costs incurred in representing the Trust.
