Beth rydym yn ei wneud

Mae Gwasanaeth Cynghori Perfformiad Ymarferwyr yn darparu cefnogaeth i Bartneriaeth Cydwasanaethau GIG Cymru a’r Byrddau Iechyd GIG Cymru a enwebwyd ganddynt. Mae hyn yn cynnwys:

Rydym yn darparu cyngor diduedd i sefydliadau gofal iechyd yng Nghymru er mwyn ymdrin yn effeithiol â phryderon a godir ynglŷn ag ymarfer meddygon, deintyddion, fferyllwyr ac optometryddion unigol a’u datrys.

Mae’r berthynas rhwng cyflogwyr a’n cynghorwyr cyswllt yn cael ei gwerthfawrogi’n fawr fel modd i gefnogi prosesau gwneud penderfyniadau. Cynnal Safonau Proffesiynol yng Nghymru

Ers 2015, rhaid ymdrin â phryderon ynglŷn â gallu, perfformiad ac ymddygiad ar gyfer yr holl feddygon a deintyddion a gyflogir gan Fyrddau Iechyd Lleol neu sefydliadau GIG eraill yng Nghymru drwy ddefnyddio fframwaith Cynnal Safonau Proffesiynol yng Nghymru (CSPNg). Rydym yn cyfeirio at hwn pan fyddwn yn helpu’r rhai sy’n gyfrifol am reoli perfformiad ymarferwyr i ganfod eu ffordd drwy’r hyn all fod yn bryderon cymhleth ynglŷn ag ymddygiad neu faterion clinigol, gyda golwg ar gefnogi datrysiad cynnar tra’n parhau i hyrwyddo diogelwch cleifion a diogelu’r cyhoedd.

Perfformiad contractwyr

Rydym yn gweithio gyda Byrddau Iechyd i ddarparu cyngor a chefnogaeth mewn perthynas â phryderon am ymarferwyr sy’n contractio gyda nhw e.e. Meddygon teulu gofal sylfaenol, deintyddion, fferyllwyr ac optometryddion.

Gwaharddiadau/Atal dros dro a chyfyngu ar ymarfer

Mesur byrdymor, dros dro ydy gwaharddiad rhag ymarfer fel arfer, er mwyn tynnu ymarferwyr o’u man gwaith arferol hyd nes y bydd natur ac achos pryder ynglŷn â pherfformiad wedi’u deall. Gallai hynny fod trwy ymchwiliad ffurfiol neu drwy gyfnod o weithredu lleol neu ailhyfforddi. Ar gyfer meddygon a deintyddion a gyflogir, rhoddir manylion y broses ar gyfer gwahardd ymarferydd yn CSPNg.

Ar gyfer meddygon a deintyddion ar y Rhestr Cyflawnwyr, nodir y rhesymau dros wahardd yn Rheoliadau’r Gwasanaeth Iechyd Gwladol (Rhestri Cyflawnwyr) (Cymru) 2004.

Yn y ddau sector, rydym yn darparu cyngor a her pan fydd unrhyw ymarferwyr yn cael eu gwahardd neu eu hatal dros dro er mwyn sicrhau bod y penderfyniad yn gymesur ac yn deg. Mewn sawl achos, gall cyfyngu ar ymarfer fod o fwy o gymorth ac rydym yn gallu darparu cyngor a chefnogaeth mewn perthynas â’r dewisiadau eraill yn lle gwahardd neu atal dros dro drwy drafodaeth fanwl am yr achos.

Rydym yn darparu adnoddau i helpu gyda phrosesau gwneud penderfyniadau, cofnodi a rheoli gwaharddiad, yn ogystal â rhannu’r hyn a ddysgwyd o achosion gwahardd dros gyfnod o ddeng mlynedd.

Asesu ac Unioni

Mewn rhai achosion, gallwn gynnal asesiad o berfformiad clinigol neu ymddygiadau proffesiynol, a gallai hynny helpu i wneud amgylchiadau’r ymarferydd unigol yn eglur a dod i’w deall.

Rydym hefyd yn drafftio cynlluniau gweithredu ar gyfer ymarferwyr sydd angen cefnogaeth i ddarparu ymarfer diogel ac effeithiol neu sy’n dychwelyd i’r gwaith wedi cyfnod hir o absenoldeb.

Nod yr ymyriadau hyn ydy:

  • cefnogi datrysiadau rheolwyr lleol, sydd yn amserol ac yn deg, er mwyn datrys pryderon ynglŷn â pherfformiad.
  • darparu gwybodaeth i gynorthwyo rheolwyr lleol gyda phenderfyniadau am y camau nesaf wrth iddynt ymdrin â’u hachosion.
  • helpu i amddiffyn y cyhoedd a sicrhau diogelwch cleifion.

Pan fydd trafferthion yn y berthynas rhwng gweithwyr iechyd proffesiynol, gall ein gwasanaeth cyfryngu helpu i gefnogi camau i’w datrys. Neu, os yw’r pryderon yn ymwneud â’r modd y mae tîm clinigol yn gweithredu, gallwn gynnal adolygiad tîm er mwyn canfod unrhyw rwystrau rhag datrys y problemau ac awgrymu cynllun ar gyfer gwella perthnasoedd proffesiynol yn y tîm.

What we do

The Practitioner Performance Advice Service provides support to the NHS Wales Shared Services Partnership and their nominated NHS Wales Health Boards. This includes:

We provide impartial independent advice to healthcare organisations in Wales to effectively manage and resolve concerns raised about the practice of individual doctors, dentists, pharmacists and optometrists.

The relationship between an employer and our link advisers is highly valued as a way of supporting decision-making. We receive consistently high levels of satisfaction from our users across the health system, which include Medical Directors, HR professionals and Responsible Officers. Feedback highlights that our service “provides a good sense check and helps to identify an appropriate way forward” when considering actions relating to performance concerns.

There is no threshold for getting in touch with us, so please make contact as soon as you become aware of a performance, capability or conduct concern.

We welcome contact from individual practitioners who may be seeking advice about performance concerns or might wish to know more about the services we provide. For example, a practitioner may want help clarifying procedural aspects of the management of their case, be concerned about some aspect of their own practice, or wish to access advice about rebuilding their skills after a career break. We can also provide information about other avenues of support that may be available to practitioners

Upholding Professional Standards in Wales

Since 2015, concerns around capability, performance and conduct for all doctors and dentists employed by Local Health Boards or other NHS organisations in Wales must be addressed using the Upholding Professional Standards in Wales (UPSW) framework. We refer to this when helping those responsible for managing practitioner performance navigate their way through what can be complex behavioural and/or clinical concerns, with a view to supporting early resolution, whilst promoting patient safety and public protection.

Contractor performers

We work with Health Boards to provide advice and support around concerns about practitioners who contract with them e.g. Primary care GPs, dentists, pharmacists and optometrists.

Exclusions/Suspension and restriction of practice

Exclusion from practice is usually a short-term, temporary measure to remove a practitioner from their usual place of work until the nature and cause of a performance concern are understood. This may be via a formal investigation or through a period of local action or retraining. For employed doctors and dentists, the process to exclude a practitioner is detailed in UPSW.

For doctors and dentists on the Performers List, the reasons for suspension is specified within The National Health Service (Performers List) (Wales) Regulations 2004.

In both sectors, we provide advice and challenge when any practitioner is being excluded or suspended to ensure that the decision is both proportionate and fair. In many cases, restriction of practice can be more helpful and we are able to provide advice and support on the alternatives to exclusion or suspension through detailed case discussion.

We provide resources to help with decision making, documenting and managing an exclusion, as well as sharing learning from exclusion cases over a ten-year period.

Assessment and Remediation

In some cases, we can carry out an assessment of clinical performance or professional behaviours, which help to clarify and understand the circumstances of the individual practitioner.

We also draft action plans for practitioners who need support to deliver safe and effective practice or who are returning to work after a long absence.

The aim of these interventions is to:

  • support local management solutions, which are timely and fair, to resolve concerns about performance
  • provide information to assist local management in decisions about the next steps in their management of their cases
  • help ensure public protection and patient safety.

Where there are relationship difficulties between healthcare professionals, our assisted mediation service can help support their resolution. Alternatively, if concerns relate to the functioning of a clinical team, we can undertake a team review to identify any barriers to resolving the issues and suggest a plan for improving professional relationships within the team.

Education

Our evidence based, CPD accredited training workshops help provide the knowledge and skills to identify, manage and support the fair and timely local resolution of performance concerns. Led by experienced advisers, delegates have opportunity to learn in a safe and supportive environment where they can interact, gain knowledge, test approaches, network and share good practice.

Workshops can be tailored to suit organisational needs and delivered face to face or via MS Teams. In-house events and ‘public’ access courses for individual bookings are also available.
