The following information was requested:
I request data on all clinical negligence claims relating to gastroenterology services with incident dates between 1 April 2014 and 31 March 2024 (financial years 2014/15 to 2023/24).
Scope: Claims where gastroenterology was the primary specialty involved Claim Status: All open and closed claims (successful, unsuccessful, withdrawn)
Based on data successfully obtained in comparable specialty studies (Oglesby et al. 2022, Majeed 2021, Lane et al. 2021, Tabner et al. 2022), I request the following information for each claim:
- Temporal Information Financial year of incident Financial year claim notified Financial year claim settled (if closed)
- Claim Status and Outcome Claim status (open/closed) Claim outcome (settled in favour of claimant/defendant/withdrawn) Whether claim proceeded to litigation (yes/no)
- Patient Demographics Patient age group at incident (5-year age bands: 0-4, 5-9, 10-14, etc.) Patient sex (male/female)
- Clinical Information Location of incident (endoscopy unit/ward/outpatient/emergency department/other) Incident description (brief free text) Description of injury (brief free text)
- Causation and Injury (NHS Resolution Standard Coding) Primary cause code (as recorded in NHS Resolution database) Primary injury code (as recorded in NHS Resolution database) Brief description of alleged negligence Brief description of harm caused
- Financial Data (for closed claims) Damages paid to claimant (£) Claimant legal costs (£) Defence legal costs (£) Total claim cost (£)
