The following information was requested and clarified:
Could you please provide me with a list of claims categorised under the specialty of paediatric neurosurgery (that is neurosurgery performed in patients under 18 years of age) from inception of the Clinical Negligence Scheme for Trusts (CNST) to date.
For each claim, please provide the following data-points:
1. Age
2. Claim open or closed?
3. Where the claim is closed, was it withdrawn or settled out of court or litigated in court
4. Year of alleged incident
5. Year of claim (notification date/year)
6. Date and value of any payment made to the claimant and overall legal costs for claim
(broken down into defence legal cost, claimant legal costs and claimant payments/damages)
7. Cause and type of injury leading to the claim based on NHSLA classification(s)
8. Brief description of incident.
The intention is to produce a report of interest to England-based practicing paediatric neurosurgeons regarding the areas of practice that are most high risk for litigation, and to identify areas of potential improvement.
