I’m hoping to get hold of some data from your team about compensation claims due to delays to treatment.
Are you able to provide me with the following information:
- The total number of claims in England for delay to diagnosis each year since 2010
- The total number of claims in England for delay to treatment each year since 2010
- Analysis of the primary causes / specialties for both delays to treatment and delays to diagnosis each year since 2010
- The number and cost of diagnosis delay claims that were closed or settled with damages since 2010 (full settled value rather than amount already paid)
- The number and cost of treatment delay claims that were closed or settled with damages since 2010 (full settled value rather than amount already paid)
- For each individual trust the number of claims and the total paid (inc. damages and legal costs for both sides)

Average time from NHSR notification to settlement for CNST claims (FOI_5704)

The average number of years from NHSR notification to settlement for CNST claims which were successful (i.e. where damages were awarded).
Could you please break down your response by damages value band, and provide data for the following years between 2012/13 and 2021/22.

Private Detectives Final (FOI_5705)
The following information was requested:
In a previous FoI response [Ref FoI_3040] you gave details on the number of times you engaged private detectives to investigate a potential claimants’ day-to-day activities. This response provided data for 2013/14, 2014/15, 2015/16 and 2016/17. Could you now supply similar data, including cases where exaggeration of injury was observed, for 2021/22.
In relation to the last five years could you please provide a list of the principal injury of those people who were investigated AND where exaggeration was observed. Please note I am just asking for a list, not a count relating to each type of principal injury.
