I would like to make a fresh FOI request.
- What are the existing injury codes under which NHS Resolution logs and categorises personal injury claims by NHS staff?
- Under which general injury code does NHS Resolution file long COVID personal injury claims?
- Would it be within cost limits for NHS Resolution to review how many of the NHS staff personal injury claims in the last two years related to long COVID, for each of the following NHS Trusts:
– Imperial Healthcare NHS Foundation Trust
– Barts Health NHS Trust
– University Hospitals Birmingham NHS Foundation Trust
Claims data broken down into causes, specialties, and trusts

I would like to look at the number of claims (and costs) per year in the last 10 years. I would like to have the data broken down into causes, specialties, and trusts. Would it be possible to obtain this data?

1. How much has the NHS paid in compensation to NHS patients for operations and treatments in non NHS hospitals and treatment centre in (a) 2019/20 and (b) 2021/22 and what was the most common injury category for payment in each of those years?
2. Can you provide a table of all the injury codes for the cohort of payouts in relation to Question 1 and the number of claims against each code?

The following information was requested:
1. Please disclose what data NHS Resolution holds on NHS staff or former NHS staff who have developed long COVID.
2. Does NHS Resolution hold national statistics on NHS staff who have developed long COVID? If so, what are the statistics?
3. What type of database/ spreadsheet does NHS Resolution have on NHS staff who have developed long COVID?
4. What are the names of the rows and columns in your database/ spreadsheet?
5. Does NHS Resolution hold information on the number of claims that the NHS received from staff or former staff regarding personal injury due to long COVID?
6. If so, please disclose the number of NHS staff or former staff who have made personal injury claims related to long COVID, and give a breakdown of the subgroups of staff or former staff according to any data held centrally by NHS Resolution on sub-groups.
7. If NHS Resolution holds data centrally on the numbers of these claims by employing NHS trust, please give a breakdown of the numbers of claims received by employing NHS trust.

Failure / Delay Diagnosis – cancer (FOI_5596)
The following information was requested:
1. Can you provide me with data (based on the financial year 2021/2022 in which the claim was paid) arising from a general misdiagnosis (which I believe has the cause code “Failure/Delay Diagnosis”), where this is either the first or second cause of the claim? Please state the number of successful claims and the total amount of damages paid to settle these claims.
2. If a NHS Trust had ten or more claims paid out within the three year period of 2019/20, 2020/21 and 2021/22 where misdiagnosis was either the first or second cause of the claim then please provide the name of the trust and the total value in compensation in relation to those claims and the number of those claims for the three year period?
3. Please provide the three highest figures that have been paid out to patients where claims were found in their favour in 2021/2022 where misdiagnosis was either the first or second cause of the claim?
4. Can you provide me with data (based on the financial year 2021/2022 in which the claim was paid) arising from a general misdiagnosis (which I believe has the cause code “Failure/Delay Diagnosis”), where this is either the first or second cause of the claim and where “cancer” or “malignant” is in the free write field? Please state the number of successful claims and the total amount of damages paid to settle these claims.
