Advice service re Guy’s and St Thomas’ NHS FT
The following information was requested:
I would also like you to share with [named person] and I the data you have regarding Guy’s and your service.
- Do they use it frequently?
- How do they compare to the national average?
- Are there any concerns you have? You will note that Guy’s did poorly in the previous WRES report, in particular on the metric regarding race and formal hearings.
- I am presuming you keep data regarding race. Do you keep data recharging mental illness and neurodiversity?
Foreign body left in situ and Wrong site (FOI_5552)
The following information was requested:
1. Please could you provide me with the total number and the total value of claims paid out by the NHSLA for the financial year 2021/2022 where ‘surgical/foreign body left in situ” is one of the grounds for claiming showing damages paid and costs paid.
2. Please also provide the individual amounts of compensation paid for the five biggest awards and please state what the foreign body was?
3. For the last financial year 2021/2022 how much compensation has been paid out in total by the NHSLA as a result of wrong site surgery? (i.e. operating on the right leg instead of the left etc.).
4. For the last financial year 2021/2022 what was the largest single payment made for compensation as a result of wrong site surgery?
5. For the last financial year 2021/2022 what was the total number of claims paid out as a result of compensation for wrong site surgery? Also, provide a list giving a brief explanation of each wrong site surgery claim. E.g. wrong eye, wrong knee, wrong kidney etc.
Please note that this question refers to claims paid out in 2021/22 regardless of when the claim was lodged or when the incident took place.
Blood Transfusion
The following information was requested:
I am making the following request under the Freedom of Information Act and should be grateful for a response from NHS Resolution (NHSR).
1) An indication as to the number of claims NHSR has received over the last few
years related to blood transfusion. Please can the numbers be broken down into each
financial year. I have not stipulated the number of years to make it as easy as possible.
A minimum of five years would be ideal but if that is too difficult/not possible then
whatever is easiest for NHSR.
2) The cost of these blood transfusion claims to the NHS. These figures do not
need to be broken down into compensation and solicitors costs just the overall figure
will be fine.

Hospital Acquired Infection
The following information was requested:
1. Please provide me with a table showing how many successful claims were lodged against
each individual NHS hospital trust for the total of the last ten financial years (2009/10 to 2020/21 inclusive) where one of the injury codes was a hospital acquired infection. Only include trusts where there were ten successful claims or more.
2. For the ten hospital trusts with the most claims please state what the total amount of
damages was that were awarded to the patients for those ten years from each of those trusts.
3. Please could you provide me with a breakdown of payments made under the CNST scheme where injury 1, 2 or 3 is for Hospital Acquired Infection (HAI) for 2020/21. This should include the number of successful claims, the damages paid and the costs for both defendant and claimant.
4. How many claims has NHS Resolution received where one of the injury codes a patient
claims to have suffered from because of NHS negligence is Covid-19? What is the status of
these claims? I.e. How many have been received, how many have been rejected, how many
has it been accepted that the NHS was at fault, how much in damages has been paid out on
these successful claims?

In the most recent NHSR annual report, claimant legal costs for clinical negligence claims were reported as £470.9 million in 2021/22. Can you breakdown this figure by the top 20 claimant firms, and provide the number of claims these costs relate to (as in the previous FOI response: FOI_5229.
