Fatality Claims
The following information was requested:
1. How many clinical negligence claims involving a fatality were paid out in the 2020/21 financial years?
2. What was the total amount of damages paid in relation to these claims?
3. For the financial year 2020/21, please provide a breakdown of the cause of death, where a claim has been made of negligence involving the death and a payout was made to the claimant?
4. In 2020/21 which ten NHS Trusts have had the most number of claims made against them for fatality where a payout has been made? For each of these ten trusts please provide (i) the name of the trust, (ii) the number of fatality claims paid out and (iii) the total value of the damages paid out in those claims.
NOTE: Please note that this question relates to the year in which the claim was settled, not the year the incident happened or the year the claim was lodged.

Cerebral Palsy – Brain Damage (FOI_5418)
The following information was requested:
Please provide:
a) the total paid by all trusts under the Clinical negligence scheme for trusts (CNST) for the past 5 years (2017, 2018, 2019, 2020, 2021) and
b) the total paid by all trusts under the Clinical negligence scheme for trusts (CNST) for the past 5 years (2017, 2018, 2019, 2020, 2021) which related to birth injury.

Having taken a look at the response (5367) you shared, we would be interested in having the claims stats that relate to injury code ‘Cerebral Palsy’ for the past five years. To be clear, we are not interested in this information broken down by trust, CCG or IS, we just want the totals for England.
As you set out in response 5367 we would like the data to cover the number of claims received in the past five years; a breakdown by specialty; a breakdown by primary injury; numbers settled with associated costs; numbers with no damages paid and numbers currently open.
