Inadequate Nursing Care, Infusion Problems and Intubation Problems

The following information was requested:

1)The number of litigation claims made against NHS England due to Inadequate Nursing Care, Infusion Problems and Intubation Problems over the last 5 complete years.

2)The cost of litigation claims, including legal costs and compensation, due to Inadequate Nursing Care, Infusion Problems and Intubation Problems over the last 5 complete years.

3)The top ten hospitals for the number and cost of claims due to Inadequate Nursing Care, Infusion Problems and Intubation Problems over the last 5 complete years.

Inadequate Nursing Care

The following information was requested:

1. For each of the last three financial years 2018/19, 2019/20 and 2020/21 please state how many claims were paid out in that year and what was the total value of those claims paid out in that year where either the first or second recorded `cause’ logged for the claim was `inadequate nursing care’?

Note: I require the data relating to the number of payouts and the value of the payouts made in the year, regardless of when the claim was actually lodged.

2. In relation to the claims paid out in each year under Question 1 please provide me with a breakdown of the numbers that were logged under each type of injury claim?

3. In relation to the claims paid out in each year in Question 1 which 5 Trusts had the highest value of claim payments made against them. Please name the Trust, the total value of these paid claims that were paid out the year and the number paid out by the Trust in that year.

Note: If you do not yet have finalised data for the 2020/21 financial year then please just provide me with data for each of the two earlier years.

Obstetrics Claims against Mid and South Essex NHS Foundation Trust

• The number and cost of Obstetrics Claims that were closed or settled with damages
since 2010 (full settled value rather than amount already paid)
• Analysis of the primary injuries code for Obstetrics Claims against NUH since 2010
• Analysis of primary causes codes for Obstetrics Claims against NUH since 2010.
And for Mid & South Essex NHS Foundation Trust:
• The number of Obstetrics Claims against the Trust since its creation
• The number and cost of Obstetrics Claims that were closed or settled with damages
since its creation in 2020 (full settled value rather than amount already paid)
• Analysis of the primary injuries code for Obstetrics Claims against NUH since its
creation
• Analysis of primary causes codes for Obstetrics Claims against NUH since its creation

The following information was requested:

c. Had any data rendered permanently inaccessible by a systems or equipment failure?

d. Paid a ransom due to a ransomware incident / to obtain a decryption key or tool?

f. Had a formal policy on ransomware payment?

g. Held meetings where policy on paying ransomware was discussed?

h. Paid consultancy fees for malware, ransomware, or system intrusion investigation?

i. Used existing support contracts for malware, ransomware, or system intrusion investigation?

j. Requested central government support for malware, ransomware, or system intrusion investigation?

k. Paid for data recovery services?

l. Used existing contracts for data recovery services?

m. Replaced IT infrastructure such as servers that have been compromised by malware?

n. Replaced IT endpoints such as PCs, Laptops, Mobile devices that have been compromised by malware?

o. Lost data due to portable electronic devices being mislaid, lost or destroyed?

2. Does your organisation use a cloud based office suite system such as Google Workspace?

3. Is an offsite data back-up a system in place for the following?

4. Are the services in question 3 backed up by a single system or are multiple systems used?

5. Do you have a cloud migration strategy? If so is there specific budget allocated to this?

6. How many Software as a Services (SaaS) applications are in place within your organisation?

The following requests are made under the Freedom of Information Act 2000 and are made in respect of each of the last 5 NHSR Accounting years. The requests are made in tabular form for ease and I should be grateful if your responses would, where figures are provided, be in the same tabular form.

In respect of each of the NHSR accounting years 16/17, 17/18, 18/19, 19/20 and 20/21, in respect of all claims where the treatment giving rise to the claim was provided by a private healthcare provider with the indemnity provided under one of the clinical negligence schemes please provide: see table.
