I would like data on medico-legal claims made in respect of neurosurgical conditions in patients under 18 years old over the last 10 years. This would include (but not restricted to) clinical negligence and personal injury claims. I would grateful for a breakdown, year by year, to look at trends and get an understanding of the nature/reason for the claims.

Hand and wrist surgery
The following information was requested:
Utilising the CNST speciality codes; ‘Orthopaedic Surgery’ and ‘Plastic Surgery’ please provide the following data for all closed (or active PPO claims) from 2010 to 2020 (classified by year of resolution)
• Date of Incident
• Cause code
• Injury code
• Incident Location
• Value of Legal Costs
• Year of closure/ settlement year for PPOs
• Whether the claim was successful
• Incident description for each claim (as documented in the incident description field)
• Total Damages Awarded (including paid and outstanding damages)
The purpose of this request is to document the hand and wrist pathologies most likely to lead to successful claims. This data will be fed into projects aimed at improving clinical practice and patient safety in hand and wrist surgery moving forward.

Wrongful Birth
The following information was requested:
In relation to the (2019/20) financial year please state how many claims you paid out where the injury code has been “wrongful birth” and what was the total paid out in damages and the total in costs for those claims. Please state how many of the claims involved the birth of children who were healthy, how much the damages were for those cases and what the total sum paid out was in those cases.
NOTE: The breakdown per year should be on the basis of the year in which the payment was made regardless of when the incident took place of when the claim was lodged.
