The following information was requested:

1. The total amount, over the last 10 years, paid out to patients of the University Hospitals of Morecambe Bay NHS Foundation Trust relating to the orthopaedics department.

2. The total number of (settled) claims paid out to patients of the orthopaedics department at UHMBT over the last 10 years.

3. Can the above information be given for each year, over the last 10 years, i.e. 2013: 12 claims £25,000. 2014: 6 claims £10,000 etc.

Top 25 highest paid claimant firms

The following information was requested:

It will be in the interest of the public and benefit my research if the NHS Resolution can name all the claimant law firms who have recovered claimant damages and legal fees from the NHS each year from 2014 to 2020.

Please can you provide the total claims settled in favour of the claimant, amount recovered by each firm by financial year and provide the types of Causes, Injuries, Speciality related to those settlements for each year.

My request relates to clinical negligence claims.

Video Conferencing

1. Do you have any video conferencing hardware? If so what manufacturer and model?

2. Is there a support contract in place for this equipment?

3. How many systems / meeting room systems do you have? Across how many sites?

4. What video conferencing platforms do you use with this video conferencing hardware?

5. What solutions are being used for Video Consultations at present? When is the next review of this contract?

6. Do you use a video conferencing platform for interoperability (i.e. Teams to Zoom, Zoom to WebEx etc.)?

7. Does the organisation use Microsoft Teams for video conferencing? Has its usage overtaken any previous video conferencing tool in place before Microsoft Teams’ implementation?

8. Who is in charge of the Video Conferencing Estate / Equipment? What is their email address?

Maternity Incentive Scheme

The following information was requested:

Repayments to the NHS Resolution maternity incentive scheme are outlined in an Independent article today (Hospitals forced to repay millions after falsely claiming their maternity units were safe) that reports the involvement of a total of 7 NHS Trusts.

Can you tell me the names of all 7 Trusts please?

And, if possible, the amounts repaid by each?

Lastly, can you advise the reason for these repayments?

 

Primary Care Appeals

The following information was requested:

I would be grateful if you could inform me:

(1) of the names of the parties to the 20 APMS disputes referred to in Annex 1 of the Primary Care Appeals (Cases completed, ’18-19) in Factsheet 6: Primary Care Appeals: Annual Statistics 2018-19,

(2) why the pattern of the APMS disputes (no cases received ‘17-19, no cases completed ‘17-18) differs from the pattern for the GMS and PMS disputes,

(3) when the 20 APMS disputes were received,

(4) where I might read the decisions on the disputes,

(5) as to what the asterisk and words on page 4 of Factsheet 6 below the table – “*Excludes 20 APMS cases”- is referring,

(5) whether there has been any update of Factsheet 6.

Cancer patients before and during the pandemic

The following information was requested:

Could you please supply me with the following information concerning clinical and medical negligence complaints from cancer patients before and during the pandemic?

1. What guidance, if any, is given on medical negligence complaints, particularly from cancer patients, and the basis on which they can be rejected?

2. What was the number of medical negligence complaints from cancer patients received in 2020?

Could I also please get the number of complaints for 2019?
If possible, could this data also be filtered into the type of cancer e.g. lung?

Ambulance Services Trusts claims

• update request for data from 2018-2020 (same questions as for FOI F/3290 which gave data for years 2002-2017) ;

• plus a request for further detail of individual claims: o circumstances of claim; a brief description of each incident, and

o how much was the cost of each claim to the NHS/taxpayer (amount of payout or costs Awarded?)

My FOI request:

the same questions How many cases of litigation have been brought against NHS ambulance services since 2002?

What was the nature of these claims? for a breakdown of data as per FOI F/3290, for the period 2018-2020?

i.e.:

1. Request for data from all successful claims (clinical or non-clinical) closed, or settled as a periodical payment order (PPO) for all NHS Ambulance Services Trusts (data grouped from 2002/3 to 2019/20; addition of data for years 2017-2020).

2. How much was the cost / claim settlement award for each individual clinical and non-clinical claim, for cases from 2002-2020*?

3. What were the circumstances (brief description of each incident) for each individual claim? (e.g.: including name of any equipment being used; what happened / what went wrong?).

This information I am requesting relates to c 4230 successful claims against the NHS (assuming case rate of c 230 year, given 3450 successful claims 2002-2017).

*I am particularly interested in costs/detail/common causation elements for:

Clinical, harm to patients: as per Table 3 successful clinical claims

• spinal damage (9 between 2002-17

• brain damage

• fatality

• cardiac arrest

• unnecessary pain

• fracture

Non-clinical, harms to staff (just staff) as per table 4 successful non clinical claims

• orthopaedic injuries (2457) – breakdown to understand what types of injury; any equipment or working practices implicated

• psychiatric damage (129 cases)
