information from NHS Resolution. Please may you provide me with:

where any injury is ‘Cerebral Palsy / Brain Damage’ and the Specialty is ‘Obstetrics’ or
‘Neonatology’ broken down by NHS trust

2. The number of Clinical Claims and Incidents between financial years 2019/20 and 2023/24
where any injury is ‘Cerebral Palsy / Brain Damage’ and the Specialty is ‘Obstetrics’ or
‘Neonatology’ broken down by Primary Cause

3. Number and Cost of Clinical Claims Closed (or settled with a periodical payment order)
between financial years 2019/20 and 2023/24 with a damages payment, where the where any
injury is ‘Cerebral Palsy / Brain Damage’ and the Specialty is ‘Obstetrics’ or ‘Neonatology’
broken down by NHS Trust including the damages and legal costs paid up until the end of each
relevant financial year of closure, or for PPO matters, year of settlement.

Bedsores or Pressure Sore (FOI_6904)

The following information was requested:

1. In the 2023/24 financial year how many patients successfully claimed damages after claiming that they suffered bedsores as a result of negligent treatment at the hands of the NHS?

2. What was the total amount of damages paid as a result of these claims?

3. How many patients who successfully claimed for bedsores also claimed for an amputation as a result of a consequence of suffering bedsores?

Please note the question relates to the year the payment was made irrespective of when the incident happened or when the claim was lodged.”

2. The number of claims against NHS Trusts for Surgical Errors/Negligence in the last 5 years? Can this be broken down by year and by cause? Financial Years: 2019/20, 2020/21, 2021/22, 2023/24.
3. The number of claims against NHS Trusts for Surgical Errors/Negligence in the last 5 years? Can this be broken down by year and by injury? Financial Years: 2019/20, 2020/21, 2021/22, 2023/24.
4. The number and cost of claims against NHS Trusts for Surgical Errors/Negligence in the last 5 years broken down by Trust and year. (Including No. of claims, Damages Paid, NHS Legal Costs paid, Claimant legal costs paid, Total paid)

(Clarification)

Could you please provide information about claims related to all surgery specialty so: Cario, General, Neuro, Oral & Maxillo Facial, Orthopaedic, Plastic and Vascular.

If this isn’t possible then information related to just General Surgery claims will suffice.

Assault claims (FOI_6896)

The following information was requested:

For each calendar year respectively 2024, 2023, 2022, 2021 and 2020:

Can you please tell me the number of claims made to NHS Resolution where NHS staff were assaulted at work? (broken down by each trust)

How many of the claims were settled with damages pay outs?

How much was paid out in total by each trust in relation to the settled cases and the damages?

Once again can you please break this down – naming the individual trusts?

Obstetrics CP_BD payments broken down by parental income bracket (FOI_6895)

The following information was requested:

I am writing to you under the Freedom of Information Act 2000 to request the following information regarding maternity damages payments:

1) Total damages paid out (in £) in the specialty of ‘Obstetrics CP/BD’, broken down by parental income bracket, for the three most recent financial years for which data is available (e.g. 23/24, 22/23, 21/22 – or nearest years).

I understand parental income is an important factor used to calculate damages awarded for loss of future earnings, so this data should be held.

The brackets can be whichever are routinely used to record this data. If this data is not routinely grouped into brackets, then please use the following parental income brackets: £0 to £12,500 per annum, £12,501 to £30,000, £30,001 to £50,000, £50,001 to £80,000, £80,001 to £100,000, £100,001 to £125,000, £125,001 to £150,000, £150,000+.

2) The total number of ‘Obstetrics CP/BD’ cases in which damages were awarded in each relevant year (as above) for each of the parental income brackets (as above).

General Surgery (FOI_6892)

Service: Claims Management Speciality: General Surgery

The following information was requested:

Could you please provide me with the following information please:

1. Litigation claims and payouts for General Surgery operations in the last 10 years (ideally per annum breakdown)
2. Litigation claims and payouts for Colorectal Surgery operations in the last 10 years (ideally per annum breakdown)

Is it possible to break these figures down to each operation in General & Colorectal surgery?

Average response time for letter of response to claim (FOI_6940)

The following information was requested:

Are you able to disclose how many NHS Resolution claims are responded to on average within the 4 month timeframe please?

Information about typical response times would be useful if there is no specific data to accompany this. If a statutory duty deadline is missed is there any guidance for the process or policy around this please?

Assault claims made by paramedics and ambulance staff (FOI_6887)

The following information was requested:

I am writing to request information under the Freedom of Information Act, can you please provide the following?

1. The number of physical assault claims that have been made by paramedics and ambulance staff in the past five years as a result of being harmed by members of the public or by patients while on duty? (Between March 31 – April 1). Broken down by years 2019/2020, 2020/21, 2021/22, 2022/23, 2023/24.

1a) Can this also be broken down by Ambulance Trust (i.e. the number of claims made by staff per Trust)

1b) Can this be broken down by primary injury and again by primary cause.

2. Can you provide the number and cost of such claims closed (or settled with a periodical payment order) between financial years 2019/20, 2020/21, 2021/22, 2022/23, 2023/24 with a damages payment?

2a) Can this be broken down by Ambulance Trust and type of Ambulance employee?
