Inadequate Nursing Care (FOI_6749)
The following information was requested:
1. In relation to the 23/24 financial year please state how many claims were paid out in that year and what was the total value of those claims paid out in that year where either the first or second recorded `cause’ logged for the claim was `inadequate nursing care’? Please could the data be provided in a similar format and on the same basis as a previous FoI response [Ref: FoI_5181].

Note: I require the data relating to the number of payouts and the value of the payouts made in the year, regardless of when the claim was actually lodged.
2. In relation to the claims paid out under Question 1 please provide me with a breakdown of the numbers that were logged under each type of injury claim?
3. In relation to the claims paid out in Question 1 which 5 Trusts had the highest value of claim payments made against them. Please name the Trust, the total value of these paid claims that were paid out the year and the number paid out by the Trust in that year.

Missed Fracture Claims (FOI_6746)
The following information was requested:
I am looking at the breakdown of the claims settled for the fractures missed by the A&E. For example- Wrist fractures, Ankle fractures, Foot fractures, shoulder fractures, Elbow fractures and Forearm fractures. I am also looking for paediatric missed fracture claims.
Can you give me that kind of information for the past 5 years if difficult at least for the past 2-3 yrs)

Include claims related to ‘poor outcome fracture’ injury code as well as ‘fracture’ injury code …please can you provide overview data for all fracture injuries and poor outcome fracture injuries by all specialties as well as highlighting proportion within this dataset that are attributed to radiology and emergency department.

Can the data include the damages and legal costs paid up until the end of each financial year of closure, or for PPO matters, year of settlement. Broken down by year, primary cause, by injury and by NHS Trust.

Foreign body and Wrong site surgery (FOI_6745)
The following information was requested:
1. Please could you provide me with the total number and the total value of claims paid out by the NHSLA for the financial year 2023/2024 where ‘surgical/foreign body left in situ” is one of the grounds for claiming showing damages paid and costs paid.
2. Please also provide the individual amounts of compensation paid for the five biggest awards and please state what the foreign body was?
3. For the last financial year 2023/2024 how much compensation has been paid out in total by the NHSLA as a result of wrong site surgery? (i.e. operating on the right leg instead of the left etc).
4. For the last financial year 2023/2024 what was the largest single payment made for compensation as a result of wrong site surgery?
5. For the last financial year 2023/2024 what was the total number of claims paid out as a result of compensation for wrong site surgery? Also provide a list giving a brief explanation of each wrong site surgery claim. E.g. wrong eye, wrong knee, wrong kidney etc.
Please note that this question refers to claims paid out in 2023/24 regardless of when the claim was lodged or when the incident took place.
Clinical Negligence Claims Provision (FOI_6743)

For 2019/20 – 84.1 million
For 2020/21 – 2,209.3 million
For 2021/22 – 2,402.8 million
For 2022/23 – 2,641.7 million
1) May I please seek figures for Provision of liabilities, for the above years i.e. Damages Provision Cover, for the year 2019/20,20/21,21/22 & 22/23
Figures will be much higher than the amount already paid for damages in respective years, as not all cases will have come to light or settled.
2) Please advise, are the funds for “Provision of Liabilities” carried forward,
if so for what period of time and how and where these funds are held.

Sepsis (FOI_6737)
The following information was requested:
I am enquiring about data request we have for information in NHS England.
We want to see data since 2010 on sepsis relate claims, both numbers are payout related information.
For all reasons and broken down by speciality if applicable.
If possible, at a provider / ICB level but if not at least by NHSE region or other regional breakdown.
Lastly, an over figure for what proportion of all NHSR cases are sepsis related both as % and cost alongside other clinical areas/categories for comparison would be helpful context.
Please could you direct me to where this information could be obtained from, if obtainable?
