Further to your response to our request numbered FOI_6573, I would be grateful if you could provide updated information including the most recent year (2023/24). For completeness our request is:

1. The number of clinical negligence claims were made by people in prison (i.e. people held in prison at the time of the alleged negligence), where damages were paid out for the financial years 2019/20, 2020/21, 2021/22, 2022/23 and 2023/24? Please provide the information broken down by financial year.

2. The total amount of damages paid in relation to these claims? Please break this down into general damages, special damages and legal costs for each of the financial years in 1 above.

3. For the financial years stated in 1 above, please provide a breakdown of the primary cause of damages, where a claim has been made where a payment(s) was/were made using the cause codes used in the NHS Resolution’s electronic case management system as set out in the ‘Speciality-injury-and-cause-codes.xlsx’ spreadsheet).

4. For the financial years listed in 1 above please confirm which ten NHS Trusts have had the most number of claims made against them by people held in prison (at the time of the alleged negligence), where a payment of damages has been made? For each of these ten trusts please provide (i) the name of the trust, (ii) the number of claims paid out and (iii) the total value of the damages and costs paid out in those claims.

Thank you for the response.

My initial request was for the individual trust data broken down by year for the last 5 financial years. Although there is the total for the last 5 years, this doesn’t reflect which trusts accounted for the figures. Therefore, is it possible to provide the data per trust for negligence claim injuries and causes for each year for the last 5 years?

Manual Handling (FOI_6700)

The following information was requested:

1. What has been the cost of claims made to (ambulance service) by patients or others for manual handling incidents?
2. What has been the cost of claims made to (ambulance service) by ambulance staff for manual handling incidents?

Would it be possible to have the last three financial years please?

Gynaecology (FOI_6690)

The following information was requested:

Under the Freedom of Information Act (2000) please would you provide the following information:

For each of the last 10 years, the number of gynaecology (not obstetrics) claims (successful and unsuccessful) submitted to the NHSLA concerning:

1. Unnecessary pain
2. Psychiatric/psychological damage
3. Failure to obtain informed consent
4. Out-patient hysteroscopy (diagnostic and operative)

Cerebral Palsy, Brain Damage, Stillbirth, Neonatal death (FOI_6693)

1. The number of clinical negligence claims where the main injury is recorded as cerebral palsy, stillbirth, neonatal death, and paediatric death (paediatric death figures are only required if the initial claim type before the child died was cerebral palsy or brain injury).

Number and Cost of Clinical Claims Closed (or settled with a periodical payment order) between financial years 2019/20, 2020/21, 2021/22, 2022/23, 2023/24, with a damages payments, where the speciality is ‘community mental health services’ or ‘psychiatry/mental health’. Can the data include the damages and legal costs paid up until the end of each financial year of closure, or for PPO matters, year of settlement. Broken down by primary cause, by injury and by NHS Trust.
