Medication Errors (FOI_6350)

The following information was requested:

One of the ways of raising awareness of the risks associated with medicines use is to look at the cost of claims when things go wrong. With that in mind, we would like if possible to know what the total annual costs are of claims where a medicine has been implicated in a resolution our region [North East North Cumbria (NENC) & North East & Yorkshire].

Reason for the rise in the number of claims (FOI_6342)

The following information was requested:

Published NHS Resolution figures suggest that, after removing the effect of Existing Liabilities Scheme for General Practice (ELSGP) from the total of all reported clinical claims, “numbers [of clinical negligence claims] rose in 2022/23 by 8.6%, compared to an increase of 0.03% between 2020/21 and 2021/22”

I would like to be provided with all information produced during 2023 that is held by NHS Resolution and refers to the reasons, or potential reasons, for the rise in the number of those claims. The information I am interested in may be held in – but will not be limited to – emails, memos and reports.

Informed Consent, Failure to Warn in minors (FOI_6344)

The following information was requested:

1. Claims received where the patient is under 18 (17 years old and under) where informed consent/fail to warn is the main cause?

2. Claims settled where the patient is under 18 (17 years old and under) where informed consent/fail to warn is the main cause?

6. Claims received, and claims settled where the patient is under 18 (17 years old and under) where ‘failure to warn/informed consent’ is a cause and ‘removal and retention of organs’ is also a cause?

Claims about Death or Life changing injuries for minors (FOI_6347)

The following information was requested:

In 2020- 2023 please list the number of successful claims that were awarded against the following NHS Trusts – that were a result of clinical negligence that resulted in either death or life changing injuries for persons under the age of 18. Please list the total expenditure for the value of these claims for each Trust for the same period- broken down into damages paid, NHS legal costs and claimant legal costs paid.

2. What was the total sum paid out in successful and settled clinical negligence claims related to stillbirths against NHS trusts in England per annum in 2023 and 2022? Please provide the data broken down by year and NHS trust.

3. What was the total number of successful clinical negligence claims related to cerebral palsy against NHS trusts in England per annum in 2023 and 2022? Please provide the data broken down by year and NHS trust.

Assault claims (FOI_6345)

The following information was requested:

RE – FOI_5990_Assault-claims

In relation to my previous FOI request during the middle of last year [FoI_5990], you duly provided figures for four [4] of the five [5] years worth of data I requested.

You stated that the data for the period 2022-23 had not been finalised and therefore couldn’t then be provided. Could you please confirm if that data is now available and, if it is, could forward it to me as per the original FoI request?

Could you please supply the following information for the applicable time periods [between 1st April to 31st March for each of the finncial years 2013-14 to 2017-18].

How many claims for personal injury have been submitted by members of NHS staff within Trusts [include both substantive, bank, honoury, PFI, or agency personnel] wherein the injury/harm caused was as a result of any alleged attack/assault/violent act, perpetrated by a patient/visitor/patients relative, or other service user.
