Failure, Delay Diagnosis or Wrong Diagnosis (FOI_6297)

The following information was requested:

Under the Freedom of Information Act, I would like to request the following information:

1. Number of claims made for ‘failure/delay in diagnosis’ and/or ‘wrong diagnosis’ for the following years and by NHS trust: 2022 – 2023 to 2013 – 2014

2. Please provide information, year-wise on the incorrect diagnoses received by patients. What conditions were misdiagnosed or experienced delays in detection?

3. Value of claims successfully closed or settled, including periodical payment orders from 2013 to 2023 where the Primary Cause is failure/delay in diagnosis or wrong diagnosis.

4. Please include claims related to mental health between 2013-2023 and their outcomes.

Acute Trusts – Fail to warn, informed consent (FOI_6285)

The following information was requested:

Please could you send me the following information for the financial years 2020-21, 2021-22, 2022-23:

1. For Acute NHS Trusts, the number and value of claims successfully settled which had a primary cause code of “Fail to warn – informed consent”.

2. For Acute NHS Trusts, the number and value of claims successfully settled which had “Fail to warn – informed consent” as a cause code, regardless of whether it was the primary cause or not.

Diathermy Burns (FOI_6278)

The following information was requested:

Please answer this question for the time period between 01/01/23 and 31/10/23.

1) How many times have NHS Resolution been notified of clinical negligence claims relating to surgical burns to patients in England over this period? Please tell me what hospitals the burns happened in, the date on which the burns happened and the amount of money NHS Resolution paid in damages and legal costs for each of the claims. Please also send me the redacted claim submitted by the patient/the patient’s lawyers, which sought compensation from the burn, along with the response(s) from the trust. This will likely be in the form of an e-mail or letter, but could be a combination of both. Please also send the reports/surveys done after the incident to assess what caused the situation, and the best ways to prevent patients being burnt during surgery in the future.

2) For each of the calendar years between 2018 and 2022, please tell me how many times NHS Resolution were notified of clinical negligence claims relating to surgical burns to patients in England.

Wrong Site Surgery, Foreign body left in situ claims for named Trusts (FOI_6276)

The following information was requested:

Please can you provide the information for the queries below, in relation Lancashire Teaching Hospitals NHS Foundation Trust as well as Blackpool Teaching Hospitals NHS Foundation Trust.

Please can the answers be separate per Trust.

1. Please could you provide me with the total number and the total value of claims paid out by the Trust during 2023 where ‘surgical/foreign body left in situ” is one of the grounds for claiming, showing damages paid and costs paid.

2. Please also provide the individual amounts of compensation paid for the five biggest awards and please state what the foreign body was.

3. During 2023, how much compensation has been paid out in total by the Trust as a result of wrong site surgery?

4. During 2023, what was the largest single payment made for compensation as a result of wrong site surgery?

5. In 2023, what was the total number of claims paid out as a result of compensation for wrong site surgery? Also provide a list giving a brief explanation of each wrong site surgery claim. E.g., wrong eye, wrong knee, wrong kidney etc.

Please note that this question refers to claims paid out 2023 regardless of when the claim was lodged or when the incident took place.

Malnutrition (FOI_6273)

The following information was requested:

How many claims have been settled in the last five financial years up to and including 2022/23 where one of the injuries is recorded as malnutrition? Please state how many were (i) settled with no damages and (ii) settled with damages paid?

For those where damages were paid, please state the (i) total of these damages, (ii) the defence costs paid and (iii) the claimants’ costs paid?

NOTE: These questions relate to when the claim was paid or closed, not when the claim was lodged or when the incident took place.
