For each of the four tables provided, please would you also be able to provide the following:

  • A breakdown of the data by each individual year (i.e. data for 2018/19, 2019/20, 2020/21, 2021/22 and 2022/23)
  • As well as the data for each individual damages band/ tranche, for each table could you also include a further row which provides the data for all damages bands (e.g. for table 2, which covers unrepresented claimants, a further row covering the average amount of compensation for all Successful Clinical Claims)

Childbirth Injury (FOI_6259)

The following information was requested:

(…) Specifically, we are interested in data related to negligence claims:

1. How many negligence claims are completed annually following the stillbirth of a child during delivery, and what is the average payout for these cases?
2. How many negligence claims are completed yearly following the death of a mother, and what is the average payout for these cases?
3. How many negligence claims pertain to intrapartum or postpartum haemorrhage, and what is the average payout for these cases?
4. How many annual negligence claims involve child injury leading to cerebral palsy?

Pelvic Exenteration (FOI_6254)

The following information was requested:

I’m trying to find out whether there were any claims made in relation to a specific surgical procedure called pelvic exenteration which is used in the treatment of some advanced or recurrent cancers. I’ve had a look in the attached booklet and on the NHS Resolution website but I’m not sure where to look to find the answer to this question.

 

Trust Level Claims Data (FOI_6252)

The following information was requested:

Please list all of your member NHS trusts or NHS organisations, that you handle clinical negligence claims on behalf of. Please list these in Table A and in a separate column/columns please provide the total amount paid out on behalf of each member Trust in clinical negligence claims for the following financial years: 2015-16 to 2022-23

The figure should be inclusive of all legal costs, and any damages paid out to the claimant.

In a separate part of the request (schedule B)
Please provide the date that each of the trusts in the lists above became a member trust with NHS resolution.

In the last part of the request (section C) please can you clarify if an NHS Trust chooses not to be a member, who would hold the data relating to the claim in terms of the total clinical negligence spent of that Trust? Obviously, the NHS trust would hold data for its own claims, but there would be a reporting mechanism somewhere within NHS England – and which department would hold the aggregate of all of this data? If the answer is still NHS Resolution – then in Schedule C please provide the aggregate amount for each of these

Payments for Clinical Claims (FOI_6250)

The following information was requested:

In line with the freedom of information act 2000 please provide the total amount in GBP paid out by the NHS for clinical negligence claims for each of the following years: 2015-16 to 2022-23, please include all legal fees within this total expenditure.

Please also list the three individual NHS trusts for each year listed above -that have the highest amount paid with respect to clinical negligence (and include each of these figures in your answers next to the NHS Trust responsible for that figure). For example:

2022-23 total £2.7 billion. 1) Frimley NHS Trust £35 million, Southampton NHS £28 million, Epsom £19 million etc but do this for each year listed above.

I understand this information is held by NHS Resolution, as many of the Trusts choose to allow NHS England to handle and settle their clinical negligence cases. In addition, your website clarifies that the information I am requesting is held by yourselves. I have seen no need to provide identification alongside my request (having read your guidance notes) because I am not asking for any specific personalised data relating to any individual.

Trust data – how claims are resolved (FOI_6246)

The following information was requested:

– A breakdown by organisation (for example, which trust) of the number of claims NHS Resolution has settled/resolved and the method by which they were settled/resolved (for example, mediation, trial) for each of the following five financial years: 2018-19, 2019-20, 2020-21, 2021-22 and 2022-23

If this breakdown cannot be provided by years because the numbers are too small, please could I have:

– A breakdown by organisation (for example, which trust) of the number of claims NHS Resolution has settled/resolved and the method by which they were settled/resolved (for example, mediation, trial) during all of the last five financial years (e.g. 2018-19 until 2022-23)

Top 25 highest paid claimant firms (FOI_6248)

The following information was requested:

Please could you provide an update to the information previously requested from NHS Resolution on medical negligence claims made between the financial years 2019/20 to 2022/23?

I would like information on the top-25 highest-paid claimant firms by the sum of claimant costs paid as well as the number of claims settled and paid and separately the total damages paid out. I would also like it identified which of those claims separately have been unsuccessful, as well as the total sum of the rest of the firms outside the top 25 (but these need not be identified). In previous requests this has also been provided with a percentage share of the total and I would like this included as well.
