I noted the supressed low figures – is there any chance we can resubmit to find out:

  • The total number of successful clinical negligence claims related to surgical TVT/TAT/TOT mesh against Torbay and South Devon NHS Foundation trust since 2006
  • The total sum paid out in successful and settled clinical negligence claims related to surgical TVT/TAT/TOT mesh against Torbay and South Devon NHS Foundation trust since 2006

So not the data provided by year but a total figure?

Clinical Claims with damages of £1,000 – £25,000 (FOI_6214)

The following information was requested:

NHS Resolution previously provided the attached information under the Freedom of Information Act FOI_5513.

Under the Freedom of Information Act, could you please provide an updated version of the table provided in the FOI_5513 response to include the year 2022/23 and, if possible, the year 2018/19.

Inadequate Nursing Care (FOI_6208)

The following information was requested:

1. In relation to the 22/23 financial year please state how many claims were paid out in that year and what was the total value of those claims paid out in that year where either the first or second recorded `cause’ logged for the claim was `inadequate nursing care’? Please could the data be provided in a similar format and on the same basis as a previous FoI response [Ref: FoI_5181].

Note: I require the data relating to the number of payouts and the value of the payouts made in the year, regardless of when the claim was actually lodged.

2. In relation to the claims paid out under Question 1 please provide me with a breakdown of the numbers that were logged under each type of injury claim?

3. In relation to the claims paid out in Question 1 which 5 Trusts had the highest value of claim payments made against them. Please name the Trust, the total value of these paid claims that were paid out the year and the number paid out by the Trust in that year.

Litigants in person (FOI_6200)

The following information was requested:

  1. The number of clinical claims closed/ settled by NHSR where the claimant was unrepresented (i.e., did not have legal representation), broken down by damages value band.
  2. For those claims identified in question 1, the average amount of compensation (including, if possible, estimated PPO payments) which was awarded, broken down by damages value band
  3. The number of clinical claims closed/ settled by NHSR where the claimant was represented (i.e., had legal representation), broken down by damages value band
  4. For those claims identified in question 3, the average amount of compensation (including, if possible, estimated PPO payments) which was awarded, broken down by damages value band.

Can you please provide this data for clinical claims which were closed/ settled in 2022/23, 2021/22, 2020/21, 2019/20 and 2018/19. Please only include claims which resulted in an award of damages
