The following information was requested:
- Please could you provide me with the total number and the total value of claims paid out by the NHSLA for the financial year 2022/2023 where ‘surgical/foreign body left in situ” is one of the grounds for claiming showing damages paid and costs paid.
- Please also provide the individual amounts of compensation paid for the five biggest awards and please state what the foreign body was?
- For the last financial year 2022/2023 how much compensation has been paid out in total by the NHSLA as a result of wrong site surgery? (i.e., operating on the right leg instead of the left etc).
- For the last financial year 2022/2023 what was the largest single payment made for compensation as a result of wrong site surgery?
- For the last financial year 2022/2023 what was the total number of claims paid out as a result of compensation for wrong site surgery? Also provide a list giving a brief explanation of each wrong site surgery claim. E.g., wrong eye, wrong knee, wrong kidney etc.
Please note that this question refers to claims paid out in 2022/23 regardless of when the claim was lodged or when the incident took place.

Top 10 legal firms with most claimant costs (FOI_6155)
The following information was requested:
All questions relates to the clinical negligence scheme (CNST)
1. In the 2022-2023 financial year please state which ten legal firms received the most money from the NHSLA in relation to claimant costs for the clinical negligence scheme (CNST) ? For each of the ten firms please state how much money they received in relation to claimant costs for the clinical negligence scheme (CNST) in the financial year? For each firm also please state how many claims this represents, and the damages that were paid in these cases.
2. In total how much money was paid in legal costs in 2022/23 and how this was divided between NHSLA legal costs and claimants’ legal costs? How does this total figure compare with previous years’ figures?
3. What was the biggest settlement to a legal firm in respect of claimant’s legal costs for a single case that was settled in 2022/23? For that case please state the amount of damages paid, the claimant’s costs and the name of the legal firm in question and the NHSLA ‘S legal costs associated with the case. Please state if the case was settled following a court hearing or not and what the injury was that the patient suffered from.
4. In relation to only those cases that were settled in the 2022/23 financial year and the claimant damages paid were in excess of £100,000, which single case saw the biggest claimant’s legal costs as a multiple of the claimant’s damages? For that case please state the amount of damages paid, the claimant’s costs and the name of the legal firm in question and the NHSLA ‘S legal costs associated with the case.
5. In relation to only those cases that were settled in the 2022/23 financial year and the claimant damages paid were in excess of £1,000, which single case saw the biggest claimant’s legal costs as a multiple of the claimant’s damages? For that case please state the amount of damages paid, the claimant’s costs and the name of the legal firm in question and the NHSLA ‘S legal costs associated with the case.
Note: In relation to Q.4 and Q.5 I am after the biggest multiple. So costs of £600,000 on a case settled for £150,000 damages would be x4, and bigger than costs of £2m in a case settled for £1m which would be x2. Also note I have dropped a request for the nature of the injury so as not to fall within the scope of S.40.
