West Essex PCT contract (FOI_5954)
The following information was requested:
I asked the DHSC for some information about West Essex PCT relating to when they sought or received information relating to PDS child only dental contracts in 2008 (Uttlesford PCT). I was party to one of these contracts which were terminated but have data showing that information was released saying that these could be changed to GDS contracts on a like for like basis. Hence the request to identify when the PCT became aware of this information. It would also be feasible that the same PCT had other PDS child only contract due to expire in 2009 (Epping PCT).
Is it possible that you have the data that would confirm or deny if these contracts were terminated as per the contract or if they were allowed to convert to GDS as the revised guidelines suggested. If also available would be any internal questioning of the concerns with the same PCT having two different contract for the same services but having different criteria (2-year and 3-year durations). Was it discussed to alter them?

Fatality Claims (FOI_5951)
The following information was requested:
1. How many clinical negligence claims involving a fatality were paid out in the 2021/22 financial years?
2. What was the total amount of damages paid in relation to these claims?
3. For the financial year 2021/22, please provide a breakdown of the cause of death, where a claim has been made of negligence involving the death and a pay-out was made to the claimant?
4. In 2021/22 which ten NHS Trusts have had the most number of claims made against them for fatality where a pay-out has been made? For each of these ten trusts please provide (i) the name of the trust, (ii) the number of fatality claims paid out and (iii) the total value of the damages paid out in those claims.

Burns (FOI_5952)
The following information was requested:
I am currently looking to investigate the trends and data in litigation claims in the NHS for patients suffering from burns and possible mis-management of these cases. I am asking to request data for any litigation cases since 2010 in relation to burns management cases in the NHS. Any information that can be provided is greatly appreciated but we would want to see the following especially:
– number of claims (total and successful) – total cases we can then look at yearly
– payout from claims
– comparison with other medical specialities and what the cost of claims broadly is in other specialities
– cause of claims
– any further information

Wrongful Birth (FOI_5934)
The following information was requested:
In relation to the (i) (2020/21) and (ii) 2021/22 financial year please state how many claims you paid out where the injury code has been “wrongful birth” and what was the total paid out in damages and the total in costs for those claims. Please state how many of the claims involved the birth of children who were healthy, how much the damages were for those cases and what the total sum paid out was in those cases.
NOTE: The breakdown per year should be on the basis of the year in which the payment was made regardless of when the incident took place of when the claim was lodged.
