Further to your response, I would like to amend my freedom-of-information request as follows for datasets pertaining to claims under:
- injury codes: brain damage and respiratory failure, in each of the speciality codes below
- speciality codes: intensive care medicine; respiratory medicine/thoracic medicine, casualty/A&E, neurology, neurosurgery, cardio surgery and cardiology
- cause codes: N/A
- from the years 2017 to 2021 in England
Mesothelioma, Asbestos Exposure (FOI_5898)
The following information was requested:
I would like to repeat a request I made in 2019 in order to update my information for the charity Mesothelioma UK. I would like the most recent 15 years of data.
1) How many civil law cases of negligence have been taken against the NHS by current or former NHS employees who have developed mesothelioma and have sued because they believe it is due to asbestos exposure at work? I would like to know on a year-by-year basis
i) Number of claims received,
ii) Number of claims settled with a damages payment resolved in favour of the employee,
iii) Number of claims settled without a damages payment resolved in favour of the NHS,
iv) Number of claims resolved at trial with damages approved, set by court
v) Number of claims resolved out of court
I would also like two collated pieces of information (i.e. not broken down year-by-year)
vi) Number of claims received by gender
vii) Number of claims received by occupation type
Ophthalmology_Difference in data (FOI_5894)
The following information was requested:
Follow up to FOI_5773.
I’m trying to compare what looks to be a steep rise in ophthalmology payments in the latest year with payments in other specialties. So I’m wondering why the stats in your FOIs don’t seem to match up to the annual report figures published here: Annual statistics – NHS Resolution
For example, the FOIs say total payments for closed ophthalmology clinical claims were £49,152,144 in 2021/22 and £26,694,710 in 2020/21. However, in the supplementary spreadsheet, these figures were listed as £41,307,386 and £40,537,522 respectively.
Would appreciate your help in clearing this up.
