I am seeking the following information:
1. Claims and Incidents Data
Please provide, in a tabular or otherwise easily readable format, the total number of clinical negligence claims and incidents involving mental health or psychiatry lodged against NHS Trusts in England from January 2013 to April 2025.
2. Per-Trust Breakdown
For the same period, please provide a breakdown by NHS Trust, showing:
- The number of claims and incidents per Trust
- The total amount of damages paid out by each Trust in relation to mental health or psychiatry claims
3. Causes and Injuries
Please provide a breakdown of:
- The leading causes of mental health and psychiatry negligence claims (e.g., failure to protect from self-harm, delays in treatment, inadequate risk assessment, etc.)
- The leading types of injuries or harm alleged in these claims
4. Trends and Thematic Analysis
Has NHS Resolution OR its predecessor organisations ever commissioned or produced any trends and thematic analysis reports regarding mental health and psychiatry negligence claims for the period in question? If so, please provide access to, or copies of, these reports.
5. Review of MOU Effectiveness with CQC
Has NHS Resolution ever commissioned or conducted a review regarding the effectiveness of the Memorandum of Understanding (MOU) between NHS Resolution and the Care Quality Commission (CQC) for the period in question? If so, please provide a copy of any such review, particularly regarding trends analysis and data insights shared between the two organisations on medico-legal issues.
