The following information was requested:
I am writing to request information under the Freedom of Information Act 2000.
Scope of request
Please provide information relating to clinical negligence claims involving missed or delayed diagnosis of acute myocardial infarction (AMI), including but not limited to STEMI, NSTEMI, or “acute coronary syndrome subsequently confirmed as MI”.
For the avoidance of doubt, this request refers to claims where the primary or contributory allegation includes:
– Missed diagnosis of AMI
– Delayed diagnosis of AMI
– Failure to recognise ECG changes consistent with acute MI
– Failure to escalate, convey, or act on suspected MI
Requested data
For each financial year 2014/15 to 2023/24 inclusive, please provide:
1. The number of clinical negligence claims closed in that year where the allegation included missed or delayed diagnosis of AMI.
2. The total damages paid (£) for those claims (excluding legal costs).
3. The total claimant legal costs paid (£) for those claims.
4. The total NHS legal costs paid (£) for those claims.
5. A breakdown (where available) of claims by organisation type, specifically:
– Ambulance trusts
– Acute hospital trusts
6. Where possible, the subset of the above attributable to London Ambulance Service NHS Trust.
Coding and definitions
If NHS Resolution uses internal cause, allegation, or injury coding (e.g. diagnostic error, cardiovascular injury, emergency medicine, ambulance services), please use those codes to identify relevant cases.
If exact diagnostic specificity (“missed myocardial infarction”) is not available, please include the
closest applicable coded category and explain the limitation.
Exclusions
– Claims still open or unresolved
– Claims closed with nil damages
– Other NHS Resolution schemes (unless unavoidable due to data structure — if so, please specify).
