Inappropriate discharge (FOI_7449)
The following information was requested:
For the last financial year 2024/2025 please provide a breakdown of:
1) The number of claims where you have paid out damages where one of the reasons stated within the claim was that the patient was inappropriately discharged from hospital?
2) The amount of money paid out in damages where one of the reasons stated within the claim was that the patient was inappropriately discharged from the hospital?
Note: Please note this question refers to last year (24/25) as the year the claims were settled
regardless of when the incident took place or when the claim was lodged.

David Fuller Claims (FOI_7450)
The following information was requested:
Freedom of Information Act Response
1. Please could you state how many claims for compensation from families of people whose relatives were abused by David Fuller have (a) been settled by you in the (i) 2022/23, (ii) 2023/24 and (iii) 2024/25 financial year and (b) what was the total value of the compensation paid to these families in the (i) 2022/23, (ii) 2023/24 and 2024/25 financial years
2. At the start of the 25/26 financial year how many claims of compensation from families of people whose relatives were abused by David Fuller were lodged with you but were at that point unsettled?
3. Since 1.4.25 how many fresh claims for compensation from families of people whose
relatives were abused by David Fuller were lodged with you?
4. Press reports have suggested that the total cost to the NHS of compensation and legal fees in relation to these cases could be as high as £25million. In responses to this question in previous years it appears the total will be nowhere this this. Could you explain to me if there are any categories of compensation, or avenues in seeking compensation from the NHS that might account for the difference?

Inadequate nursing care (FOI_7438)
The following information was requested:
1. In relation to the 24/25 financial year please state how many claims were paid out in that year and what was the total value of those claims paid out in that year where either the first or second recorded `cause’ logged for the claim was `inadequate nursing care’? Please could the data be provided in a similar format and on the same basis as a previous FoI response [Ref: FoI_5181].
Note: I require the data relating to the number of payouts and the value of the payouts made in the year, regardless of when the claim was actually lodged.
2. In relation to the claims paid out under Question 1 please provide me with a breakdown of the numbers that were logged under each type of injury claim?
3. In relation to the claims paid out in Question 1 which 5 Trusts had the highest value of claim payments made against them. Please name the Trust, the total value of these paid claims that were paid out the year and the number paid out by the Trust in that year.

MIS compliance (FOI_7432)
The following information was requested:
I am writing to request information under the Freedom of Information Act 2000 regarding the Maternity Incentive Scheme (MIS) compliance status for NHS Trusts in the last reported financial year. Specifically, I would like to request the following:
– A list of NHS Trusts that achieved full compliance with the MIS safety actions in the last reported financial year.
– A list of NHS Trusts that did not achieve full compliance, including the number of safety actions met by each non-compliant Trust.
– If available, a summary of the common reasons for non-compliance across Trusts.
– Confirmation of the financial year to which the data relates.

FOI_7433_Obstetrics and Gynaecology claims
The following information was requested:
– Could you clarify what you mean by “settled” and what you mean by ‘closed” e.g. between settled pre court/ went to court/ no admission of liability etc.
– Is there any incline as to when the incidents occurred? Because most litigation at least for ‘childhood disability’ occurs many years after the event for example.
– Do you have any more details on what the specific claims are e.g. could you provide details of the coding system used to group the Obstetric claims?
– Do you have any data on claims that were settled as opposed to claims that were closed? Is there are any data on the proportion of claims that were settled for practical or financial reasons, such as the cost of defending a claim, rather than due to an established breach of duty?
– Finally, do you have any data on unsuccessful claims i.e. What proportion were spurious? What factors helped the NHS successfully defend these cases? Etc.
