The following information was requested:

I previously submitted an FOI request which was responded to (FOI 6883).

This request was for: “information in relation to national statistics on litigation claims and damages in relation to ‘pressure ulcers’ (“Code 97”).

Specifically, I request information on the number of claims received by the NHS and a breakdown of claims closed with no damages paid, those closed with a damages payment, and the associated costs over the timeframe 2013/14 – 2023/24.

If possible, I would like a national overview of this data accompanied by a breakdown for each Trust.”

Would it be possible to receive this information again with the number of deaths associated with these claims?

 

Cerebral Palsy (FOI_7039)

The following information was requested:

Under the Freedom of Information Act 2000, I am looking for information related to the following:

Between the financial years 2013/14 and 2023/24, the total amount of compensation awarded by the Manchester University NHS Foundation Trust clinical negligence claims related to cerebral palsy.

In the same date range, give the top five trusts in order of the highest total amounts of compensation awarded for clinical negligence claims related to cerebral palsy.

Premature Payments, reimbursed payments (FOI_7034)

The following information was requested:

1) Please could you provide the number of times by financial year for the following years: 2018/19, 2019/20, 2020/21, 2021/22, 2022/23, 2023/24, and year to date for 2024/25, that claimants have been reimbursed prematurely or in error, resulting in them having to return the reimbursement to NHS Resolution.

2) Please could you also provide the total amount of money by financial year for the following years: 2018/19, 2019/20, 2020/21, 2021/22, 2022/23, 2023/24, and year to date for 2024/25, that claimants have been reimbursed prematurely or in error, resulting in them having to return the reimbursement to NHS Resolution.

3) Please could you provide the amount of money returned by claimants by financial year for the following years: 2018/19, 2019/20, 2020/21, 2021/22, 2022/23, 2023/24, and year to date for 2024/25, as a result of claimants being reimbursed prematurely or in error by NHS Resolution.

4) Please could you provide the amount of time in working days (calculated from the date of the payment run to the date the money was returned to the NHS Resolution bank account), that it took for NHS Resolution to recover any erroneous or prematurely paid claims from claimants by financial year for the following years: 2018/19, 2019/20, 2020/21, 2021/22, 2022/23, 2023/24, and year to date for 2024/25.

5) Please could you explain the approval limits by role and processes in place for payment of reimbursements to claimants by NHS Resolution.

Ian Paterson inquest (FOI_7037)

The following information was requested:

I would like to submit the following FOI request regarding the inquests into the deaths of former patients of breast surgeon Ian Paterson in Birmingham.

The information we would like is as follows:

1. How much money has been allocated to cover the costs of the inquests into the deaths of patients of Ian Paterson? Please display this information as a total, but also separate out into categories such as solicitors to the inquest, legal aid (please specify number of claimants), travel expenses (please specify number of claimants), expert witness payments (please specify number of claimants) and any other expenses categories which are relevant, such as refreshments etc.

2. If any contracts are related to the inquests, please disclose copies of these (including all indexes, appendices and supplements) and the bids to tender.

3. How much of this money is funded by the tax payer? Please tell us the total figure and as a percentage proportion of the total budget.

4. As of January 31 2025, how much has been spent so far on these inquests? Please tell us the total amount, but also separate out into categories as above.

Assault claims for Herefordshire and Worcestershire Health and Care NHS Trust (FOI_7028)

The following information was requested:

I am writing to request information under the Freedom of Information Act 2000 regarding compensation for staff assault claims within Worcestershire Royal Hospital under the Herefordshire and Worcestershire NHS Trust.

Specifically, I would like to know the following:

  1. The number of staff assault claims made within the staff at Worcestershire Royal Hospital over the past five years and a break down of the figures for each year.
  2. The total amount of compensation paid out for these claims each year.
  3. A breakdown of the types of assaults reported (e.g., physical, verbal).
  4. Any measures or policies implemented by the trust to prevent staff assaults

The following information was requested:

Under the provisions of the FOI Act, I am trying to find out more about compensation claims handled by all NHS Trusts, including the costs and details of each case. If my questions could be revised to better achieve a full disclosure, I’d be grateful for any advice you could give in that respect.

If it would exceed the cost and time limits of the Act to provide this data on a national basis (whilst this would be preferable) please limit the disclosure to the following Trusts:

  • details of the complaint received where possible
  • The date of the incident that led to the complaint
  • The date the complaint was lodged
  • The date the complaint was settled

4. Over the same period, how many claimants died while their case was on-going? In each of these cases, please provide details of their complaint and its outcome.
5. How much has the trust spent in legal fees associated with compensation over that period? Please break down by year and by legal costs awarded to claimants vs. costs incurred in representing the Trust.
