The following information was requested:
The number of closed claims filed by NHS staff and NHS patients in each of the last three financial years (2019/20 – 2022/23) relating to:
a) Faulty equipment
b) Infrastructure failures
For EACH YEAR, for both (a) and (b), please also provide:
1. The total damages paid, NHS legal costs, and claimant legal costs
2. The number of these incidents that were fatal
3. For the case with the highest sum of damages paid, please provide the nature of the claim, the injury that was sustained, and the cause of the injury.

For the ‘faulty equipment’ query, please include all of the search terms you have suggested [Defective Equipment; Defective Tools/Equipment; Medical Equipment; Medical/Office Equipment; Other Equipment; Use of Tools/Mach/Equipment]. It would be useful if you could break the data down by these search terms.
By ‘infrastructure failures’, I am referring to physical issues with the infrastructure and buildingsof the NHS estate. Examples include ceiling collapses, broken lifts etc. Please include any search terms relating to this. A summary of the cause and a separate summary of the injury would be perfectly sufficient.

Under-16 Paediatric and Orthopaedic Surgery (FOI_6533)

Regarding – FOI_5163
Failure/Delay Diagnosis & Fail delay/treatment account for majority of claims (both tables).
Is it possible to give a breakdown for these claims regarding the limb involved (e.g. elbow, wrist, ankle), age ranges of the patients, Trusts involved, department (Emergency, ward, theatre) where issue occurred and category of delay in diagnosis/treatment?

From the options outlined, I would be interested only in cases involving children under 18. Within these cases, I would be interested all of the fields outlined:

- Breakdown by primary injury

Assault claims (FOI_6522)
The following information was requested:
I am writing to request information under the Freedom of Information Act, can you please provide the following?
1. How many physical assault claims against the NHS have been made by NHS staff in the past five years? (Between March 31st, 2019- April 1 2024)?
Can this be broken down by year and by type of NHS employee? These include, Nurses and allied health professionals, Doctors/Consultants, Ambulance Workers, Support Staff etc.
1a) Can this also be broken down by NHS Trust? (i.e. the number of claims made by NHS Staff per Trust)
1b) What were the nature of these claims? Please can you discount unmeritorious (rejected) claims.
2. Can you provide the number and cost of such claims closed (or settled with a periodical payment order) between financial years 2019/20, 2020/21, 2021/22, 2022/23, 2023/24 with a damages payment?

Fatality Claims (FOI_6521)
The following information was requested:
- How many clinical negligence claims involving a fatality were paid out in the 2022/23 financial years?
- What was the total amount of damages paid in relation to these claims?
- For the financial year 2022/23, please provide a breakdown of the cause of death, where a claim has been made of negligence involving the death and a payout was made to the claimant?
- In 2022/23 which ten NHS Trusts have had the most number of claims made against them for fatality where a payout has been made? For each of these ten trusts please provide (i) the name of the trust, (ii) the number of fatality claims paid out and (iii) the total value of the damages paid out in those claims.
NOTE: Please note that this question relates to the year in which the claim was settled, not the year the incident happened or the year the claim was lodged.
