Published NHS Resolution figures suggest that Clinical Negligence payments have risen to around £2.6bn in 2022/23 from £1.3bn in 2012/13 [1,2,3].

I would like to be provided with all information produced during 2023 that is held by NHS Resolution and refers to the reasons, or potential reasons, for the rise in the level of those payments.
The information I am interested in may be held in – but will not be limited to – emails, memos and reports.
Compensation Rates for deafness claims in babies and toddlers (FOI_6340)
The following information was requested:
I understand that there is a formal assessment of the going rates of compensation awarded in respect of children whose deafness was missed by the NHS and who consequently suffer delays and deficits in communication, in some cases permanently. An example would be a deaf child who “missed the window” for cochlear implantation and will consequently never be able to develop meaningful hearing or speech.
I am looking for a copy of any document that indicates the going rate of compensation, specifically in respect of failure to identify deafness in babies and toddlers. I don’t know if there is a “rate card” or if an assessment of likely compensation has recently been done for NHS partners such as NHS England.
If there is an assessment, obviously provisional at this stage, about the total liability that NHS England may face in terms of compensation for failure to identify deafness in children, then I would request that too.

Dermatology and Rheumatology (FOI_6334)

(…) following from FOI_5940 for the years 18-19 to 21-22, I wondered if you would give me a breakdown on the diagnoses or reasons for the negligence claims for dermatology and rheumatology for the same years 18-19, 19-20, 20-21, 21-22. I am comparing rheumatology with dermatology as they are similar sized overlapping specialities, yet rheumatology has roughly half the number of claims compared with dermatology but are much higher value. Thank you for your help and excellent work in NHS Resolution.

I am writing to request information regarding decisions made under Regulation 31 for applications based on unforeseen benefits.
I recently came across your contact information on the NHS website and noted that you invite individuals to enquire about past decisions that may not be available online. I am specifically interested in obtaining information on both successful and unsuccessful decisions made under Regulation 31 for applications related to unforeseen benefit.
Could you please provide me with details of the decisions, including the basis for the decisions and any relevant information that can be shared. I am particularly interested in understanding the criteria that were considered for success or failure in these cases. Additionally, if there are any documents or guidelines related to the decision-making process that could be shared, I
would greatly appreciate it.

Removal of Testicle (FOI_6327)
The following information was requested:
1. In 2018/19, 2019/20, 2020/21, 2021/22 and 2022/23 how many claims were paid out across all schemes where the injury code has been removal of testicle and what was the total value paid out in damages for such claims?
2. For the same years as above, please state how many “removal of testicle” claims were linked to each separate type of cause code e.g. (wrong diagnosis, operation on wrong part of body etc.)
3. For the same years above, what was the highest single claim or range of claim paid out.
4. For 2022/23, which Trusts did these incidents take place at? If this would risk identification, which regions in the country?
