Cancer Claims related to specific Trusts (FOI_6244)
The following information was requested:
In accordance with the Freedom of Information Act 2000, please may I request the following information for each of the following years: 2017/2018, 2018/2019, 2019/2020, 2020/2021, 2021/2022 2022/2023 and 2023/2024 (so-far, up until date of FOI request (23/10/2023)):
– Number of claims brought for clinical negligence for cancer for misdiagnosis with Imperial College Healthcare NHS Trust as the defendant. To include specialty and primary cause.
– Number of claims brought for clinical negligence for cancer for misdiagnosis with The Royal Marsden NHS Foundation Trust as the defendant. To include specialty and primary cause.
– Number of claims settled for clinical negligence for cancer for misdiagnosis with Imperial College Healthcare NHS Trust as the defendant to include specialty and primary cause.
– Number of claims settled for clinical negligence for cancer for misdiagnosis with The Royal Marsden NHS Foundation Trust as the defendant to include specialty and primary cause. To include numbers settled with associated costs if available.
Note – I would ideally like to request numbers surrounding ‘misdiagnosis’ and ‘delayed diagnosis’.
I would accept high level data as offered in FOI_6176.
Failure, Delay Diagnosis, misdiagnoses – cancer (FOI_6242)
The following information was requested:
1. Can you provide me with data (based on the financial year 2022/2023 in which the claim was paid) arising from a general misdiagnosis (which I believe has the cause code “Failure/Delay Diagnosis”), where this is either the first or second cause of the claim? Please state the number of successful claims and the total amount of damages paid to settle these claims.
2. If a NHS Trust had ten or more claims paid out within the three year period of 2020/21, 2021/22 and 2022/23 where misdiagnosis was either the first or second cause of the claim then please provide the name of the trust and the total value in compensation in relation to those claims and the number of those claims for the three year period?
3. Please provide the three highest figures that have been paid out to patients where claims were found in their favour in 2022/2023 where misdiagnosis was either the first or second cause of the claim?
4. Can you provide me with data (based on the financial year 2022/2023 in which the claim was paid) arising from a general misdiagnosis (which I believe has the cause code “Failure/Delay Diagnosis”), where this is either the first or second cause of the claim and where “cancer” or “malignant” is in the free write field? Please state the number of successful claims and the total amount of damages paid to settle these claims.
5. If a NHS Trust had five or more claims paid out in the three year period of 2020/21, 2021/22 and 2022/23 where misdiagnosis was either the first or second cause of the claim and where “cancer” or “malignant” is in the free write field then please provide the name of the trust and the total value in compensation in relation to those claims and the number of those claims in the three year period.

Cancer claims made against GPs (FOI_6228)
The following information was requested:
In any one calendar year since the inception of CNSGP and ELSGP:
1. What proportion of complaints/claims against GPs relate to delay in diagnosis of cancers, or missed cancers?
2. Which were the commonest 5 cancers cited in order of frequency?
3. What proportion of completed complaints/claims were dismissed?
4.Of the remainder, what was the median and the largest compensation agreed?
Inappropriately Discharged (FOI_6224)
The following information was requested:
For the last financial year 2022/2023 please provide a breakdown of:
- The number of claims where you have paid out damages where one of the reasons stated within the claim was that the patient was inappropriately discharged from hospital
- The amount of money paid out in damages where one of the reasons stated within the claim was that the patient was inappropriately discharged from the hospital?
Note: Please note this question refers to last year (22/23) as the year the claims were settled
regardless of when the incident took place or when the claim was lodged.

Just wondered if you might be able to help me answer a few questions about the
attached FOI response on the private sector claims.
- Do you know if these include patients claims for Ian Paterson?
- The claims increase year on year (until 2021-22) is there a clear reason for this do you know?
- Is there anywhere I could find the equivalent figures for total claims paid to patients treated by NHS hospitals?

I am writing to request information under the Freedom of Information Act 2000. Specifically, I am seeking data related to clinical negligence claims involving Physician Associates under the Clinical Negligence Scheme for Trusts (CNST) for the fiscal years 2018/19 to 2022/23.
1. What is the total number of clinical negligence claims involving Physician Associates during this period?
2. Could you please provide a breakdown of these claims by severity (e.g., minor injuries, long-term disability, death) and financial cost (both compensation paid out, legal costs and/or total liabilities under the scheme)?
3. Are there any risk management assessments or analyses that focus specifically on Physician Associates? If so please share these documents.
