Information re to lost years element of damages (FOI_7927)
The following information was requested:
Could you please provide data regarding clinical negligence claims handled by NHS Resolution that have included a “lost years” element of damages (claims for loss of earning capacity during a projected period of premature death caused by the alleged negligence)?
Specifically, I would like to request the following information broken down by financial year for the last ten available financial years (e.g., 2014/15 to 2024/25):
Total Number of Claims: The total number of settled clinical negligence claims where the claimant’s damages assessment included a calculation for “lost years” (i.e., where future loss of earnings/earning capacity was calculated for a period after the claimant’s projected date of death, or where a Harris v Empress Motors deduction for living expenses was applied).
Age Demographics: A breakdown of these claims by the age profile of the claimant at the time of settlement or judgment (specifically distinguishing between adult claimants and child/pediatric claimants under the age of 18).
Primary Injury/Specialty Breakdown: A breakdown of these “lost years” claims by specialty or injury type (e.g., Oncology/Delayed Diagnosis, Obstetrics/Birth Injury, Brain Injury).
Settlement Value: The total or average quantum (damages paid) for the claims identified in question 1.
Refinement Strategy to Assist with Cost Limits: If extracting this specific data directly from your main database poses a difficulty or risks exceeding the appropriate cost limit under Section 12 of the FOI Act, please prioritise and provide:
Data restricted only to high-value closed claims (e.g., claims valued over £1,000,000) where a reduction in life expectancy was coded or noted in the risk/claims management system.
Amputation_Blindness_Cosmetic disfigurement (FOI_7925)
The following information was requested:
1. How many clinical negligence claims involving amputation were paid out by the NHSLA in the year 2024/25 what was the monetary value of payments made against those claims, irrespective of when the claim was made? For each amputation please list the body part or limb involved. Please give the three NHS Trusts against whom the most successful claims were paid out in 2024/25 and how many claims related to each of those trusts.
2. How many clinical negligence claims involving blindness were paid out by the NHSLA in the year 2024/25 and what was the monetary value of payments made against those claims, irrespective of when the claim was made? Please give the three NHS Trusts against whom the most successful claims were paid out in 2024/25 and how many claims related to each of those trusts.
3. How many clinical negligence claims involving cosmetic disfigurement were paid out by the NHSLA in the year 2024/25, what was the monetary value of payments made against those claims, irrespective of when the claim was made? Please give the three NHS Trusts against whom the most successful claims were paid out in 2024/25 and how many claims related to each of those trusts.
4. If possible, please answer questions 1, 2 and 3 again but in relation to the 2025/26 financial year.
Clinical negligence claims against Totally Plc_FOI_7922
The following information was requested:
I am writing to make a formal request under the Freedom of Information Act 2000 for recorded information held by NHS Resolution relating to clinical negligence claims against Totally Plc (including its trading subsidiaries such as Vocare Limited) arising from an incident that occurred in January 2018.
Totally Plc entered administration on 6 June 2025, citing as a key factor a medical negligence claim relating to a January 2018 incident, with a potential liability that could exceed its £10 million insurance cover and potentially be eight figures. This claim has had significant consequences for contractors working for Totally Plc/Vocare, including myself as a sole trader who was not paid for work performed.
I request the following information, to the extent it can be provided without breaching confidentiality or data protection:
Confirmation of whether NHS Resolution holds or has held clinical negligence claims against Totally Plc (or its subsidiaries) relating to an incident in January 2018.
The nature of the claim(s) (e.g., type of alleged negligence, clinical area, number of claimants).
The current status of the claim(s) (e.g., ongoing, settled, in litigation).
Any information on the potential or actual value of the claim(s), including whether it exceeds typical insurance limits.

Claims relating to neurosurgery (FOI_7910)
The following information was requested:
Would it be possible to have a separate request for all neurosurgery claims in the past 5 years? This would put in context the size/number of claims for brain haemorrhage in comparison to neurosurgery in general.
For the neurosurgery data, it would be helpful to know the volume and size of claims, but also any breakdown on the underlying pathologies.
Missed Diagnosis of Brain Haemorrhage (FOI_7909)
The following information was requested:
(…) In relation to your questions, the missed diagnosis of brain haemorrhage is exactly what we are looking for. The breakdown/search strategy provided in FOI 6916 and the overall burden of the disease in 7749 would be perfect. I think the data for the last 5 years would be most instructive.
