The following information was requested:
As part of our ongoing advocacy work, we have been reviewing the NHS Resolution Claims Management Database and note that:
- ‘Hydrocephalus’ does not appear to be recorded as an ‘injury type’ code; and
- ‘Failure to measure head circumference’ or ‘failure to act upon irregular head circumference’ does not appear to be recorded as a ‘cause of injury’ code.
In light of this, I would be grateful if you could confirm whether:
- ‘Hydrocephalus’ is included as an ‘injury type’ within your coding system; and
- ‘Failure to measure head circumference’ or ‘failure to act upon irregular head circumference’ is included as a ‘cause’ code.
Additionally, I kindly request the following information under the Freedom of Information Act 2000:
- The number of claims opened between 2005 and 2024 where the injury type included hydrocephalus.
- The number of claims closed (with payment of damages) between 2005 and 2024 where the injury type included hydrocephalus.
- A breakdown of damages paid, claimant legal costs, and NHS Resolution legal costs for all claims closed (with payment of damages) between 2005 and 2024 where the injury type included hydrocephalus.

Medication Error (FOI_7046)
The following information was requested:
1. I would like to know the number of successful claims paid out by NHS Resolution in the last financial year (2023/24) as well as the total amount of compensation paid to these claimants in each financial year?
2. Could you also supply me with tables showing the aggregate totals for medication error claims for the last five financial years which give (a) the number of successful claims, (b) damages paid, (c) defence costs paid, (d) claimants cost paid and (e) total paid broken down by the speciality.
3. Could you also supply me with tables showing the aggregate totals for medication error claims for the five financial years which give (a) the number of successful claims, (b) damages paid, (c) defence costs paid, (d) claimants cost paid and (e) total paid broken down by the main type of harm. Please provide this in a similar format to a previous FoI response [Ref: FoI_3607].
Please not that for all these questions I require the data to be provided based on the year the claim was paid out rather than when the incident took place, the claim was lodged or liability was accepted.

CNST Claims and ISP Claims (FOI_7042)
The following information was requested:
For the NHSR 20/21, 21/22, 22/23 and 23/24 financial years, in respect of the CNST, please
provide a breakdown in a table of:
- The number of clinical negligence claims received during the year;
- The number of claims which are now closed;
- In respect of the claims identified in 2, please state:
a. The total damages paid
b. The total Claimants costs.
c. The total Defendant costs.
Of the claims identified in 2, please provide another table with the same data fields as the
previous one including only those claims which relate to work carried out by organisations in the private sector working for Trusts under an NHS sub-contract. Please add another row in the second table for each year, detailing the total amount later recovered by NHSR from the organisation(s) to which the service was sub-contracted (whether that be from their insurers or otherwise).
