Removal of Testicle (FOI_6807)

The following information was requested:

1. In (i) 2023/2024 how many claims has the NHSLA paid out where the injury
code has been removal of testicle and what was the total value paid out in damages for
such claims?

2. Please state how many “removal of testicle” claims were linked to each
separate type of cause code e.g. (wrong diagnosis, operation on wrong part of body
etc).

(Please note that this question relates to when the claims were paid regardless of when
the incident took place or when the claim was lodged.

Treatments in non-NHS hospitals (FOI_6808)

The following information was requested:

1. How much has the NHS paid in compensation to NHS patients for operations and treatments in non-NHS hospitals and treatment centre in 2023/24 and what was the most common injury category for payment in each of those years?

2. Can you provide a table of all the injury codes for the cohort of payouts in relation to Question 1 and the number of claims against each code?

Note: The question refers to when the payout was made regardless of when the claim was lodged or when the incident happened. The answer should be provided on the same basis as was done for a previous FoI response from you [Ref: FOI_5209]

Pressure Sores (FOI_6804)

The following information was requested:

Please could you provide the following information, split by individual NHS Hospital Trusts for the financial years 2022-23 and 2023-24:

1. Pressure Sores Data:
– The total number of patients who developed pressure sores (also known as bed sores or pressure ulcers) during their stay at each NHS Hospital Trust.
– This figure as a percentage of all patients admitted to beds in each trust.

Note: If the data cannot be provided for all patients admitted to beds, please provide any available data on bed sore incidence in hospital inpatients.

2. Litigation Cases Related to Pressure Sores:
– The number of litigation cases brought against each NHS Hospital Trust, specifically due to pressure sores.
– The total financial cost of these cases to each trust.

Mesothelioma, Asbestos Exposure (FOI_6801)

The following information was requested:

I would like to request the number of compensation payouts to both NHS staff and former NHS staff related to asbestos in each of the last three financial years: 2021/22, 2022/23 and 2023/24.

I would also like to request the total amount paid in compensation related to asbestos in each of those years.

Legal Costs for Cerebral Palsy & Brain Damage Claims (FOI_6793)

The following information was requested:

1. I would like to get the legal costs (lawyer fees only) of clinical negligence claims for Cerebral Palsy for the past ten years.

2. What is the highest legal costs (legal fees only) paid out in a single claim for the past 10 years or historically

3. What is the average legal costs (legal fees only) of a clinical negligence claim for cerebral palsy to the NHS.

Trade Union spend (FOI_6786)

The following information was requested:

1. The details of any office accommodation your organisation provides to staff to carry out trade union business. Please include details of:

• space measured in square feet
• how much of this space is contained within entirely separate buildings (i.e. occupied solely by staff carrying out trade union business)
• whether a professional valuation of the market rental value of the space has been sought either in-house or externally, and if so, what the valuation of the space was
• any charges the council levy for office space given to trade unions.

2. Do you deduct trade union subscriptions for any of your employees via payroll (sometimes known as the “check off” system)? If so, do you charge a fee to the trade unions concerned for providing this service?

3. With regard to trade union facility time, please provide the total cost of facility time from your pay bill for the financial year 2023/24 and the budget for the current financial year. Please also advise the current number of employees that you fund to be union officials, measured as full time equivalents? 4. Please advise any estimates for other costs met for those staff on trade union facility time apart from salaries – including travel expenses, office supplies, telephone expenses and energy bills.

Litigants in Person (FOI_6785)

The following information was requested:

I am writing to request information under the Freedom of Information Act 2000 regarding certain key metrics related to Litigants in Person (LIPs) and general case management data. Specifically, I am seeking to understand whether the data outlined below has been incorporated into NHS Resolution’s Management Information (MI) reports to the Board, as suggested in a report presented to the Board several months ago.
In order to avoid any ambiguity or incomplete responses, I wish to emphasize that I am requesting the following information even if it is not reported directly to the Board. Therefore, please provide the requested data regardless of whether it is part of the formal MI report to the Board or collected for internal purposes or held in any other form by NHS Resolution.
